The Environmental Question in the Competitive Right Argentine and Italian

Abstract

This article intends to jointly address the points of convergence between environmental law and civil law. For this purpose, the points of contact between these areas are analyzed based on a comparison between the Italian legal system and the Argentine legal system, with special reference to the constitutional legge 11 February 2022, n. 1, which is modified in art. 9 and 41 of the Italian Costituzione, legislative decree 3 April 2006, n. 152 (Environmental Code) and the Codice della Crisi d’impresa e dell’insolvenza, legislative decree of 12th Gennaio 2019, n° 14.
