Family Enterprise in Argentinian Law According to the New Civil and Commercial Code of the Nation
Abstract
Before the entry into force of the new Civil Code in Argentina, at the time of planning the generational transit in the management and in the succession in the ownership of the family business, the applicable legislation only appeared protecting the individual interests of the members of the family, considering them as heirs with rights of public order to take inmediate possession of their legitimate portion of the inheritance in kind and to demand at any time the partition without considering the existence of the family business as such and the need for its guardianship and continuity. On the contrary, the new private law regime provides for a number of novel institutes in terms of contracts, societies, family law and succession, which is a new legal framework which is very positive for better functioning and continuity of the family business.
