The Construction of a Pragmatic Model of Legal Sources: a Permanently Present Discussion

Abstract

This paper deals with the description of a model of legal sources from a legal argumentation approach of law, in which presupposed a connection between law and morals. It connects the subject of legal sources to the question of interpretation of the law, analyzing the role played by pragmatic rationality and the legal argumentation in the side of the law, morals and jurisprudence. It also works the interference of legal methodology in building the model, considering also as a source the set of operations that is adopted for the application and justification of legal rules.
