As the practical philosophy has for ending the proposal of taking care of equal interests in society and equal good for everybody, the problem developed in this text correspond to explain how moral rules must be raised and applied, even when isn´t it enough to know why we must be moral nowadays. The idea is also to know how to solve law hard cases in the relations between privates. From the “trolley dilemma” of Philippa Foot, this text does a comparison among Habermas’, Dworkin’s, Nussbaum’s and Singer’s doctrines in practical philosophies, especially between perfectionists’ doctrines and the utilitarianism. In the end, the text offers a contribution do jurisdictional discourse in Law in order to build the right answer for the judicial case.
