Limits on Commercial Speech in Brazil and Some Lessons from the Colombian Constitutional Court

Abstract

This article investigates the legal foundation that legitimizes the protection of marketing under Brazilian law, questioning whether it stems from free enterprise, freedom of expression, or both, and what implications this distinction has for the constitutional review of restrictions imposed by public authorities. It argues that the lack of a definition regarding the legal nature of commercial advertising creates uncertainty about the parameters and level of scrutiny (weak, intermediate, or strict) applicable to potential limitations. To address this gap, the study draws on the experience of the Colombian Constitutional Court, which in 2010 examined the constitutionality of provisions banning tobacco advertising. The article is structured in three parts: the first addresses the dual nature of commercial advertising under Brazilian law, relating it to free enterprise or freedom of expression; the second examines, through a documentary analysis of Brazilian Supreme Federal Court (STF) rulings, the national understanding of the constitutionality of restrictions on commercial advertising; the third analyzes Colombian Constitutional Court Decision C-830 (2010), seeking to identify legal standards that may contribute to refining the understanding of this issue within Brazilian law.
