Damages and Contractual Good Faith: Contractual Damage in Ernest Weinrib’s Legal Formalism

This paper intends to bring to light the polemic remedy of punitive damages, awards of, arguably, non compensatory content, given in face of highly reprehensibly acts that would remain otherwise unpunished. Although such debate occurs mainly in tort law, the use of this remedy in case of contractual damage and its relation to good faith developed by Brazilian academics and jurisprudence is the goal of this study. To this intention’s objectives, we adopted the private law conception developed by the Canadian jurist Ernest Weinrib, yet also addressing other theories. We came to the conclusion that, because of the attached duties brought by the objective good faith, the use of punitive damages for contractual damages in Brazilian law has proved less controversial than one may initially suppose.
