Abstract

Following the European legal tradition the present article look forward to the possible choices and it´s influences by Jurisprudence in the constitutional perspective. Even before the constitutional interpretation technics and consequents methodology in the constitutional field, the interpreter and theoretical of law are connected in an argumentative way to one constitutional model, in one hand by regulative norms, in other jand by constitutive norms. The present article work the theoretical dimensions of normative constitutional norms and regulative constitutional norms, namely by legislative view or by the judicial view, realizing on it structural cross examination in this debate. In the end, is selected the way according to the argumentative constitutional structure.
