Value and Depreciation of Free Enterprise

The purpose of this article is to demonstrate real situations in which free enterprise must be evaluated in accordance to its social effects. The starting point is the legal hermeneutics of social value of free enterprise as a fundamental principle of the Federative Republic of Brazil aiming to verify its subject matter. Once placed that the constitutional principle is not the free enterprise itself but its social effects, the second part of the article is dedicated to ascertain negatives and positives externalities of the economic activity, taking Chronic Non-Communicable Diseases as the reference.
