Abstract

This article is intended to address the issue of the amnestied, which in administrative headquarters, received compensation for labor fund and subsequently claims the reimbursement of nonpecuniary damages in court. It undertakes a critical analysis on the rulings by Superior Court of Justice and the Federal Regional Courts on the subject and offers an interpretation of the Amnesty Committee Law in the light of the Constitution with the aim of ensuring the joinder between the repair material and moral damage.
