The Duty of Self-Protection and the Culture of Responsibility – or Freedom and Responsibility as the Foundation of Constitutional Legality

This study seeks to characterize the duty of self-protection and the culture of responsibility as the genuine ethical foundations of contemporary law. The choice by both the Italian and the Brazilian Constitutions for solidarity as a normative expression of human dignity translates a civilizing option, whereby the individual ceases to be a mere recipient of State protection and becomes an ethical protagonist of democratic coexistence. In this sense, it is argued that the culture of responsibility is the moral axis of the State of Law, acting as an antidote against the destruction of public values and the trivialization of fundamental guarantees. To this end, the duty of self-protection emerges as the way in which the subject recognizes their vulnerability and transforms prudence into civic virtue. In societies marked by the speed of information and the dispersion of attention, educating towards responsibility is a task of constitutional urgency.
