O artigo apresenta as limitações históricas à liberdade de testar na common law inglesa, a sua abolição e ressurgimento na Nova Zelândia, Austrália, Canadá e Inglaterra, bem como observa o direito sucessório estadunidense e demonstra como atualmente opera o instituto da Family provision nas jurisdições de common law.
