Violação do dever de cuidado do médico e condenação em wrongful actions: o caso Evie Toombes

Abstract

Discussions about human reproduction and consequent damages subject to indemnification often arise within the scope of civil liability. Also, about the doctor-patient relationship. In December 2021, the foreign press reported the case of Evie Toombes as unprecedented in England on the subject. Evie won the lawsuit filed against her mother's doctor for neglecting to advise her to supplement her diet with folic acid prior to pregnancy. As a result, the daughter was born with spina bifida and the disabilities resulting from her unfair life or unwanted birth. Had it happened otherwise, she would not have been conceived. So, what is the relationship between the Evie Toombes case and the so-called wrongful actions? This is a case study, aligned with the bibliographic research.
