Judiciary Power and Urban Land Conflicts: Procedural Frames of the Dispute

The article aims to present the results obtained in empirical research on the profile of the Judiciary in urban land conflicts. Considering this object, 311 decisions rendered by Courts of Justice of the five Brazilian regions in the period between 2014 and 2015 were analyzed. The systematization of the data included the characterization of the structure of the actions; The profile of the procedural subjects; The fundamentals of decisions and the sources of law mobilized. The results obtained allow us to understand in depth the jurisdictional behavior in these demands and, above all, to reflect critically on the procedural mechanisms in the reintegration of possession, the massive concession of injunctions and the legal institutes applied. In addition, it highlights the incipient justiciability of categories as the social function of property and the right to housing.
