Multi Parenting at the Succession Law: The Right To Inheritance from Biological and Affective Parents

Abstract

The present work aims to verify, under the constitutional and civil optic, the succession possibilities, when there is a biological and affective bond. To do so, it is needed to analyze the evolution of affectivity in the social field through time and the need for regulation in the legal field so that the rights inherent to the affective parentage are insured with no prejudice to the ones acquired with the biological parentage. It shows also that, despite the lack of specific regulation of the affective parentage, the existent legal provisions – it is similarly applied the provisions related to adoption –, as the doctrine and jurisprudence, indicate the insurance of the rights referred to it, in which includes the right to heritage. It is verified, yet, how the brazilian jurisprudence has been positioning about the succession, when there is a biological and affective bond.
