Abstract

This work aims to reflect upon the adequation for applying the requirements in Article 1.723 of the Brazilian Civil Code, in the context of recognizing stable unions between people of the same gender, questioning about possible misunderstandings which may result from there. By utilizing a multidisciplinary approach, indicating the necessity of a dialog between Civil-Constitutional doctrine and literature in the field of gender and sexuality, it points to the necessity of modulating the framework for stable unions of same-gender couples, therefore avoiding exclusions and negations of rights that are still operating, even in the post-May 2011.
