This article seeks to analyse the characteristics of the obligational relation from a functional perspective, especially its object – the performancebehavior. In this aspect, one analyses the theories about the role of creditor’s interest and useful result in the configuration of the performance and its eventual patrimoniality, as well as the consequences of those theories towards the depatrimonialization of private law
