The Legal Rights Conceptions of Hans Kelsen and Alf Ross

The present paper has the main aim of describing the legal rights conceptions of both Hans Kelsen and Alf Ross. It is a conceptual/descriptive metaanalysis enterprise, meaning that there is no intention of proposing a new legal rights theory or of reaching any normative conclusion about which of the two theories must be adopted in order to best understand the object. By exploring these two postures about the legal rights theme a contribution will be made to both those interested in analytical philosophy of law – focused on discovering which concept better describes the legal practice, or the very nature of the legal rights; and those that have the objective of working with political philosophy – and, because of that, need a concept of legal rights that better serve the purpose of
their own normative conclusions.
