Criteria for Decision-Making on Child Health Care: a Bioethical-Legal Analysis of the Charlie Gard Case

This paper aims to analyze the criteria commonly used in medical decision-making on behalf of children. In this sense, after addressing parental rights, we move on to analyze the criterias for this substitute decision-making, focusing on the criteria of will and preferences, the criteria of best interests and the criteria of harm threshold. Finally, a bioethical-legal analysis is made of the Charlie Gard case. It is a theoretical research based on the the theoretical framework formulated by Eler, Moschella and the studies of Goold, Hering and Auckland. At the end, it was argued that the best interests criteria must prevails because it is the one most in line with the child's human rights and the child-centered care model.
