Economic Analysis of Law and Contract Interpretation in a Civil Law System: an Analysis from art. 113, § 1, item V, of the Civil Code

The article presents a brief investigation on the limits and possibilities of a contractual interpretation that is based on the premises constructed by the economic analysis of the contract in a Civil Law system, emphasizing, in a first moment, the meanings that lead to the interpretation and / or integration of the contract according to economic analysis, mainly from the idea of contractual incompleteness, as well as the centrality and overcoming of the concept of efficiency for the interpretative solution. The second part is dedicated to understanding the impacts of the changes promoted in the Civil Code, highlighting the controversies about a concept of "economic rationality" and the possible adaptations of that concept to the Brazilian civil system.
