From Civil incapacity to Evolving Capacities: Children's Decision-Making in Healthcare

This article aims to analyze the child's capacity to make healthcare decisions, from the application of the the concept of evolving capacities in pediatric care. Methodologically, it is a theoretical and documentary research, conducted based on Albuquerque, Eler and Lansdown surveys, and on human rights law, as well as on the General Comments produced by the Committee on the Rights of the Child and the Committee on the Rights of Persons with Disabilities.
