Defects in Real Estate Acquisition: Differences between Brazilian and German Registration Systems

Abstract

Unjustified enrichment is the main solution adopted under German law to repair damages caused by defects in the abstract real estate transmission. However, in Brazilian law, such transfer of ownership is causal and Article 886 of the Civil Code establishes the unjustified enrichment as a subsidiary solution. Thus, it is relevant to question the possibility and eventual application operation of this legal remedy to the transfer of real estate in Brazil.
