The Functionalization of the Real Estate Development Contract

Abstract

This article proposes to expose, under the qualitative methodology, how the legal relationships that are established through real estate development, externalized by singular contractual instruments, play an important role in the increase of the economy while serving a greater reality, which is to dynamize access to housing, a fundamental right closely related to human dignity. The fulfillment of the economic function of the business must be aggregated by its social function, intent of the real estate development law by stimulating the social function of the property, giving it a better and wider utility, through the reconfiguration of the space through economic use of the land. The law is also concerned with mechanisms to protect the interests of the collective of contractors for fully achieving the merger, which occurs with the completion of the works and delivery of the autonomous units.
