The Right to Privacy: Notes on a Particle of the Anglo-Saxon Normative Tradition (Warren and Brandeis)

The right to privacy is studied, in its origin in the Anglo-Saxon atmosphere. The theme is pertinent, because, at the same time, laws and regulations are beeing elaborated, in order to protect the person, his privacy and personal data, in the face of the impacts of the technique. Knowing, even partially, the right to privacy, and what was said at the time of its “maturation”, is beneficial, and, therefore, some decision and doctrines are studied, together with the text by Warren and Brandeis. It is concluded that the right to privacy, since its “dogmatic origin”, was largely concerned with the person and, exceeding the mere “majority” “liberal-patrimonial” and “individualistic” notion of personality right of that time.
