Abstract

Values are neither inside nor outside: they are the other side of the system. They are not outside - there is not a content, a cosmos, a basic system on which depends or from which springs the law - in moral or elsewhere. They are not inside - because, if they were, they would be absorbed into the operations of the legal system, which in its work ends up leveling all content, eliminating the differences - as if every difference found an answer, a performance of the system, then the differences there would be no more, but there would only system performance. The values’ always being elsewhere, their allotopia, determines their function of contestating what there is: there will never be a suitable “should be”, because whatever the reality, it is always possible to imagine a different state of the world, in which the values meet a greater realization.
