Abstract

Social relations on their own are complex, where risks and uncertainties are present in the evolutionary process. The need for protection is inherent to development. The search for minimizing effects on damages has not only created a safety tool but has also made insurance a tool in aiding development economic and social growth. The discipline of insurance law essentially interacts with development, and with uncertainty and risk, in a relationship of complexity. The surety bond, as a type of insurance, integrates this system to the extent that it aims to ensure the faithful fulfillment of contractual obligations in the most varied areas of law, both public and private. In this interrelationship, this work, based on the deductive method, approaches the concepts of surety bond, development, uncertainty and risk in an evolutionary, but complex perspective, that involves its intrinsic and extrinsic aspects.
