Political Correctness and Informed Consent: an Interpretation of Patients’ Rights within Argentine Mental Health System

Abstract

This article aims at examining in what extent the ‘political correctness’ impacts on the concept and practice of informed consent expressed by mental patients. The scope of this work will be limited to the Argentine legal system of mental health. This research will be structured in the following way: (i) determination of the meaning, presuppositions and implications of ‘political correctness’. (ii) Elucidation the concept of informed consent within the Argentine legal system of mental health and through contributions of common law tradition. (iii) Articulation of the concept of ‘political correctness’ and informed consent within Argentine legal system. (iv) Critical evaluation of presuppositions and consequences of political correctness on informed consent for the Argentine mental health system. One of the main contributions of this article will be an analysis of the impact of ‘political correctness” on the notion of public health presupposed by informed consent within mental health system.
