Abstract

Many juridical norms are inspired by the duty of care extracted in its essence from the constitutional imposition of responsibility to parents. But the reality is still full of extreme situations, in which parental negligence generates grave damage, both material and psychological. The recognition of the juridical possibility of civil liability for moral abandonment is part of this context, as it creates a compensatory solution for the damages caused by the genitor’s absence, but constitutes solely one of the possible solutions.
