Hypernudges y consentimiento sustantivo: bases para un estándar jurídico de lealtad algorítmica en arquitecturas digitales de decisión

Resumo

Las arquitecturas digitales de decisión utilizadas por las plataformas configuran entornos diseñados para modular la conducta de los usuarios mediante técnicas de manipulación conductual opacas y personalizadas, conocidas como hypernudges. Tales prácticas transforman radicalmente las condiciones bajo las cuales se forma el consentimiento, poniendo en crisis los supuestos dogmáticos que sostienen la autonomía de la voluntad y la validez del negocio jurídico en el derecho privado. Este artículo analiza críticamente la suficiencia de dichas categorías tradicionales frente a los nuevos desafíos planteados, proponiendo como respuesta una reinterpretación de la buena fe objetiva que incorpore un estándar de lealtad algorítmica. Se identifican tres criterios para delimitar esta forma de manipulación ilícita: opacidad deliberada, personalización explotadora y asimetría de resultados. El hallazgo central demuestra que un régimen de responsabilidad por diseño, fundado en la buena fe, permite restablecer la protección del consentimiento en clave sustantiva.
