Este ensaio visa a proporcionar uma reflexão concisa sobre algumas das vicissitudes históricas e multiculturais enfrentadas atualmente por alguns sistemas jurídicos do Ocidente; isso especialmente
com relação à desejada efetividade de sistemas jurídicos normativos em certas regiões do Ocidente. O artigo é baseado nas experiências de sistemas em blocos supranacionais (como a União Europeia), analisando a interseção entre o direito privado e o direito público (por exemplo o direito civil e o direito constitucional) usando a comparação da dinâmica factual que estrutura a sociedade contemporânea. A preocupação máxima está em problematizar o diálogo cultural entre sistemas, incluindo uma revisão interna e sistemática, à luz dos princípios constitucionais (especialmente a dignidade humana e a solidariedade) da assimetria entre o sistema jurídico existente e a solução de reais problemas nas relações interprivadas. Para evitar um direito burocratizado, propõe-se o respeito entre diferentes sistemas
